PREAMBLE
These are the By-Laws of Branch 214 of the National Association of
Letter
Carriers. These By-Laws and those that may be adopted in the future
will
conform to the National Constitution for the Government of Subordinate
Branches and all other laws of the National Association of Letter
Carriers.

ARTICLE I
NAME AND OBJECT
SECTION 1. This Branch shall be
known
as Golden Gate Branch 214 of the National Association of Letter
Carriers
of the United States of America. SECTION 2. The object of this Branch
is
to unite all employees who are eligible for membership under Article
II,
Section 1 and 2, of the National Constitution, into one harmonious body
for their mutual benefit and to assist the National Association of
Letter
Carriers in its efforts to improve the conditions of its entire
membership.

ARTICLE II
MEMBERSHIP
SECTION 1. Application for
membership
can be made using Standard Form No. 1187 (Request and Authorization for
Voluntary Allotment of Compensation for Payment of Employee
Organization
Dues). SECTION 2. Membership shall conform to the National Constitution
of the Government of Subordinate and Federal Branches, Article II,
Sections
1, 2, and 3.

ARTICLE III
MEETINGS
SECTION 1. The regular meetings of
this Branch shall be held on the first Wednesday of every month at
7:00PM,
except where there are other provisions made in these By-Laws.
SECTION 2. Seven (7) members
shall
constitute a quorum for the transaction of business at a regular
meeting.
SECTION 3. Any regular Branch
Meeting
may be postponed by the unanimous consent of the Branch, provided the
postponed
meeting be held within the same month.
SECTION 4. When the date of the
regular meeting falls on a legal holiday, the meeting shall then be
held
on another date of the same month.
SECTION 5. Special meetings
shall
be called by the President upon written request of twenty (20) members
in good standing or by vote of the Branch, and notification of such
meetings
stating the object of the call shall be given the members by the
Secretary-Treasurer,
using all available news media.
SECTION 6. It shall take a
quorum
of seventy (70) members in good standing to transact the business of
any
special meeting.
SECTION 7. No business shall be
transacted at a special meeting other than that for which it has been
called.
SECTION 8. All Branch meetings
shall
be called to order at the time prescribed in the By-Laws if a quorum is
present.
SECTION 9. In the absence of
the
President and Vice President, any member in good standing may be
elected
to preside by a majority of those present. The meeting shall be called
to order by the senior officer.

ARTICLE IV
OFFICERS
SECTION 1. The Officers of the
Branch
shall be a President, Executive Vice President, Vice President,
Secretary-Treasurer,
Assistant Secretary-Treasurer, Safety & Health Officer, EEO
Officer,
Director of Organization, Health Benefits Representative, MBA
Representative,
Sergeant-at-Arms, and a Board of Trustees composed of three members.
SECTION 2. All Officers of
Branch
214 shall be elected biennially and hold office for two (2) years or
until
their successors are duly elected and installed. Elected officers will
assume official duties on the first regular scheduled meeting in
January,
after the election.
SECTION 3. Installation of
Branch
Officers shall be in the month of January.
SECTION 4. No officer of this
Branch
shall hold an elected national position concurrent with his/her elected
Branch position.

ARTICLE V
ELECTIONS
SECTION 1. Elections shall be
conducted
in accordance with Article V of the National Constitution.
SECTION 2. All Candidates for
office
must be present at the time of their nomination or signify in writing
their
willingness to serve if elected.
SECTION 3. No candidate for
election
as a compensatory delegate for any convention shall have been absent
from
more than six (6) of the twenty-four (24) regular meeting prior to the
election meeting. The presence of any member at a meeting of this
branch
shall be determined by a check-off by the Sergeant-at-Arms and
Secretary-Treasurer.
All candidates for compensatory delegate must be present at the time of
nomination or signify in writing their willingness to attend if
elected.
Members who have transferred into the branch from other NALC branches
in
the two (2) years prior to the election meeting, may use meetings
attended
at their former branch to help qualify as a compensatory delegate --
provided
that attendance at specific branch meetings is verified in writing, on
branch stationary, by the Recording Secretary of their former NALC
branch.
SECTION 4. Prior to the
November
Branch Meeting, the Budget Committee shall meet. They shall be
responsible
for determining a reasonable amount of money to be allowed each
compensatory
delegate to the upcoming State and/or National Convention. THE
COMMITTEE
MUST TAKE THE FOLLOWING INTO CONSIDERATION:
A. The cost of round trip coach
airfare to both the State and National Convention. If the convention
city
is not served by regular air service, then a reasonable travel
allowance
can be used, based on the Postal Service going rate, not to exceed
Twenty-five(25)
cents a mile.
B. The average total hotel
costs:
which shall be based upon the average price of a single room in the
convention
cities.
C. The cost of any non-refundable
delegate registration fees for both conventions.
D. The Budget Committee will
also
take into consideration the cost of the following National Convention
breakfasts:
HBP; MBA; Legislative; and EI and such funds shall be set aside in the
Convention Fund for the HB Representative; MBA Representative;
Legislative
Liaison; EI Facilitators and LJSC Members to attend such breakfasts, if
they are delegates.
After having arrived at the total projected cost figures, the Budget
Committee
will then ascertain how many compensatory delegates we will then send
to
the upcoming conventions.
At the November Branch meeting, the Budget Committee shall report their
findings to the membership. The members then in accordance shall have
the
opportunity to overrule or amend the recommendation of the Budget
Committee.
This shall require a two-thirds (2/3) vote.
If the number of members who are willing and eligible to be
compensatory
delegates exceeds the number arrived at by the Budget Committee, a
secret
ballot vote shall be held at the December Branch meeting, in order to
determine
which members shall be compensatory delegates to the State and/or
National
Convention.
In the event of any emergency, the members at the regular meeting may
allocate any remaining Convention Fund money for Convention purposes
ONLY.
This shall require a two-thirds (2/3) vote.

SECTION 5. Nominations for
delegates
and alternates to the State and/or National Conventions, shall be made
at the regular meeting in November prior to the Conventions. Election
of
delegates and alternates to the Conventions shall be held at the
December
Meeting prior to same.
SECTION 6. Nominations of
candidates
for elective Branch offices shall be made at the regular meeting in
October.
SECTION 7. The
Secretary-Treasurer
shall prepare a list of eligible voters, to be turned over to the
Election
Committee as soon as practicable after nominations.
SECTION 8. At the October Branch
Meeting, and prior to nominations, the President shall appoint an
Election
Committee, consisting of a Chairperson and four other members, who are
not candidates for any elective Branch Office. The Election Committee
shall
be in charge of all Election Procedures for the Branch Election of
Officers
and Delegates, subject to our Local By-Laws, the National Constitution
and applicable laws and regulations.
SECTION 9. Branch officers shall
be elected by mail referendum vote. Ballots will be mailed, by the
Election
Committee, to all eligible voters on the first Monday of November. The
election period shall encompass no less than 21 days from the date of
mailing.
SECTION 10. The election
Committee
shall be responsible for the arrangement of, or providing for the
following:
A. Shall have the necessary
number
of ballots printed showing the name of the candidate, and the office
for
which said candidate is running.
B. Names of candidates shall
be
arranged in alphabetical order under the title of office for which said
candidate is running.
SECTION 11. Ballots shall be
accompanied
by a copy of printed voting instructions and two envelopes. The larger
envelope shall be postage prepaid and have printed upon it, for the
purposes
of identification, spaces for the voter's name and address, and shall
be
pre-addressed to a Post Office Box established by the Election
Committee.
The smaller envelope shall be used for securing the ballot within the
return
envelope, and shall have no marking other than the word BALLOT printed
on it.
SECTION 12. The voter shall
indicate
a choice for each of the officers by making a CROSS [X] or a check [/]
opposite the name of the candidate chosen. The voter shall then seal
the
ballot in the smaller envelope, enclose this envelope within the larger
one, fill in the information indicated on the latter, and mail it to
the
Post Office Box printed on the larger envelope. Write-in votes shall
not
be valid. No markings shall be made on the ballot or smaller envelope
other
than as indicated in this article.
SECTION 13. All mailed ballots
shall
be removed from the Post Office Box, on the 22nd day after mailing at
9:00AM,
brought to a place previously designated by the Election Committee for
the tally, and tallied immediately after the following preliminaries:
A. They check the name on each
reply
envelope against the list of eligible voters.
B. The reply envelopes have
been
opened and segregated, and the Secret Ballot envelopes have been mixed
thoroughly, to prevent and possibility of identification (excluding
challenged
ballots).
SECTION 14. All erased or
mutilated
ballots shall be deemed null and void.
SECTION 15. The Chairperson of
the
Election Committee shall provide a sufficient number of tally sheets to
properly tabulate the vote.
SECTION 16. All voted ballots
shall
be placed in an envelope and securely sealed by the Election Committee.
This envelope shall be turned over to the Secretary-Treasurer of the
Branch,
who shall retain same for a period of one year after which the ballots
shall be destroyed, unless in such a case the vote becomes contested,
such
envelope may be opened by the vote of this branch.
SECTION 17. All stations,
including
Collection and Parcel Post, shall hold elections for Shop Stewards
Biennially
in January. All Shop Stewards shall be elected for two (2) year terms,
by a majority of the members in good standing in the respective
stations.
If a Shop Steward is unable to fulfill the term of office for any
reason,
the President shall appoint a Shop Steward until elections can be held.
SECTION 18. In an election where
there is no contest, the Secretary-Treasurer shall cast the ballot.

ARTICLE VI
DUTIES OF OFFICERS
PRESIDENT
SECTION 1A. The President shall
preside
at all meetings of the Branch, preserve order, sign all warrants on the
Assistant Secretary-Treasurer ordered by the Branch, and all other
papers
ordered by the Branch, have general supervisory powers over the Branch,
see that officers perform their duties, enforce the Constitution,
By-Laws,
rules and regulations of the Branch, appoint all committees not
otherwise
provided for, give the deciding vote when a tie occurs, examine and
announce
the result of all balloting and other votes. The President shall not
make
or second any motion or take part in any debate while in the Chair; the
President shall ascertain from the Secretary-Treasurer before
adjournment
of the meeting the amount of money received since the previous meeting,
and from the Assistant Secretary-Treasurer if same has been received.
At
the end of the term the President shall make a report showing the
progress
and condition of the Branch. The President shall, together with the
Assistant
Secretary-Treasurer, sign and file with the Secretary of Labor on
behalf
of the Branch, an annual financial report if required by public law.
The
filing of such a report will be required unless the Branch has received
express notification from the National Association that it is exempt
from
such requirements.
SECTION 1B. The President shall
be a full-time employee of Golden Gate Branch 214. He shall visit all
stations
and be available to the organization and its members for all purposes
during
a regular forty (40) hours week and evenings as needed. He shall have
the
authority to fill all vacancies that occur during his term of office.
By
virtue of his office, he shall be the Chief Steward of Golden Gate
Branch
214. He shall provide "24 hour telephone service". He shall be required
to maintain a central office where all books and papers together with
all
other property of Golden Gate Branch 214 shall be kept. He shall be
responsible
for the publishing of the official journal of this Branch, THE VOICE.
For
the faithful performance of these duties he shall receive the sum of
$33,055.46
per annum (subject to the following sentence), payable as per United
States
Postal Service pay period. This sum shall be automatically increased in
the event of salary increases granted to Letter Carriers by negotiation
with the United States Postal Service, or other event, shall be the
same
figure as the increase given to top grade Letter Carriers.

EXECUTIVE VICE
PRESIDENT
SECTION 2. The Executive Vice
President
shall be a full-time officer. The Executive VP shall preside in the
absence
of the President. In case of death, resignation, disqualification,
refusal
or neglect of the President to discharge the duties of his/her office,
the Executive VP shall assume the office of the Presidency for the
remainder
of the term. The Executive VP, under the direction of the President,
shall
be the chief branch officer in charge of Education of all stewards,
officers
and members. He/She shall have the general responsibility for Stewards'
Meetings and Training conducted by this branch. He/She shall have the
responsibility
to plan and implement regular training for all Stewards. He/She shall
assist
the Vice President in handling grievance appeals, shall be a member of
the Grievance Committee, and shall perform other duties as assigned by
the President and/or the members. Subject to the direction of the
President,
the Executive VP shall conduct regular station visits and be available
to the Branch and its members for all purposes during a forty (40) hour
week and as needed. For the faithful performance of his/her duties, the
Executive VP shall receive an annual salary of: $30,429.80, payable
bi-weekly.
This sum shall be automatically increased with the same dollar amounts
granted to top grade [Level 6, highest step] Letter Carriers, in their
salary and benefit increases by negotiation with the USPS.

VICE PRESIDENT
SECTION 3. The Vice President shall
be a full-time officer. He/she shall preside in the absence of both the
President and the Executive VP. The VP, under the direction of the
President,
shall have overall responsibility for Contract Administration, chairing
the Grievance Committee, maintaining and updating grievance logs and
other
general advocacy responsibilities. The VP shall conduct regular station
visits, be available to the Branch and its members for all purposes
during
a forty (40) hour week and as needed, and shall perform other duties as
assigned by the President and/or the members. For the faithful
performance
of his/her duties, the VP shall receive an annual salary of $30,429.80,
payable biweekly. This sum shall be automatically increased with the
same
dollar amounts grants to top grade [Level 6, highest step] Letter
Carriers,
in their salary and benefit increases by negotiation with the United
States
Postal Service.

SECRETARY-TREASURER
SECTION 4. The Secretary-Treasurer
shall be a full-time employee of Golden Gate Branch 214. Subject to the
direction of the President, the Secretary-Treasurer shall conduct
station
visits and be available to the Branch and its members for all purposes
during a forty (40) hour week and as needed. The Secretary-Treasurer
shall
process grievances and by virtue of the office, shall be a member of
the
Grievance Committee. The Secretary-Treasurer shall perform the duties
of
the Recording Secretary and the Financial Secretary as set forth in
Article
VI, Section 3 and 4 respectively, of the National Constitution of
Federal
and Subordinate Branches. For the faithful performance of these duties,
the Secretary-Treasurer shall receive the sum of $30,429.80 per annum,
payable biweekly. This sum shall be automatically increased with the
same
dollar amounts granted to top grade Letter Carriers, in their salary
and
benefit increases by negotiation with the United States Postal Service.

BENEFITS OF
FULL-TIME OFFICERS
SECTION 5. Full-time officers shall
receive all fringe benefits allowed full-time Letter Carriers (unless
otherwise
restricted in this Article) which shall include but not be limited to:
1. Twenty-six (26) days annual
leave
and thirteen (13) days cumulative sick leave; a maximum of two hundred
forty (240) hours of annual leave may be carried over each year.
a. Upon leaving office, full-time
officers will be reimbursed annual leave up to a maximum of 80 hours.
b. Full Time officers of Branch
214, who leave office without using up the sick leave they accumulate
under
Article VI, section 5.1., shall be eligible to use said sick leave only
under the following conditions:
1) They are still employed as
Letter
Carriers; and
2) They are active members of
the
NALC; and
3) They have exhausted all
Postal
Service sick leave; and
4) The circumstances are
appropriate
for the use of sick leave.
c. Retired former full time
officers
of Branch 214 who leave office without using up the sick leave they
accumulate
under Article VI, section 5.1., shall also be eligible for the
difference
between their actual annuity and the annuity they would have been
eligible
for, had their unused sick leave accumulated as branch officers been
added
to their time in service, if and only if:
1) They are retired Letter
Carriers
under CSRS (Civil Service Retirement System), or transferred from CSRS
to FERS (Federal Employees Retirement System); and
2) They are retired members
of
the NALC; and
3) They apply to Branch 214
for
this benefit. This amount shall be payable yearly.
d. Branch 214 shall keep 30% of
its
maximum sick leave liability, in a separate account, for the purpose of
fulfilling its obligations, defined under Article VI, Section 5.1.b.
and
c. above.
2. Payment by the Branch of the
employer's
share of civil service or Social Security retirement benefits, health
benefits,
life insurance benefits plus any additional health benefits needed to
protect
the Branch.
3. All holidays granted to
Letter
Carriers. 4. The cost of an adequate commercial rate automobile
liability
insurance policy.

ASSISTANT
SECRETARY-TREASURER
SECTION 6. The Assistant
Secretary-Treasurer
shall be responsible for the Branch payroll, including all attendant
records
and necessary reports as required by law. The Assistant
Secretary-Treasurer
shall also perform the duties of the Office of Treasurer as set forth
in
Article VI, Section 5 of the National Constitution of Federal and
Subordinate
Branches. For the faithful performance of these duties, the Assistant
Secretary-Treasurer
shall receive the sum of two hundred and twenty-five dollars ($225.00)
per month, payable monthly.

SERGEANT-AT-ARMS
SECTION 7. The Sergeant-at-Arms
shall
preserve order in the meetings under the instruction of the President.
It shall be the duty of this office to see that members only are
present
at the meeting unless directed by the President or a vote of the
Branch.
For the faithful performance of these duties the Sergeant-at-Arms shall
receive forty-five dollars ($45.00) per month, payable quarterly.

MBA REPRESENTATIVE
SECTION 8. The MBA Representative,
who shall be a member of the MBA, shall perform such duties as the
Constitution
and the laws of the U.S. Letter Carriers Mutual Benefit Association may
require. For the performance of these services, the MBA Representative
shall receive forty-five dollars ($45.00) per month, payable quarterly.

SAFETY & HEALTH
OFFICER
SECTION 9. The Safety and Health
Officer
will, under the direction of the President, be responsible for
monitoring
and processing of safety and health grievances. This officer will
attend
or ensure attendance at all established safety and health committees in
the Branch 214 area, and be generally responsible for improving safety
and health conditions on the job. For the performance of these
services,
the Safety & Health Officer will receive forty-five dollars
($45.00)
per month, payable quarterly.

HEALTH BENEFITS
REPRESENTATIVE
SECTION 10. The Health Benefits
Representative,
who shall be enrolled in the NALC Health Benefits Plan, shall perform
such
duties as the Constitution and the Laws of the National Association of
Letter Carriers' Health Benefits Plan require. The HBR shall, whenever
requested by the President, and at the end of the term of office, make
a report showing all receipts, disbursements and amount of money on
hand,
deliver all books, papers, and money to the successor in office, when
installed;
and to insure the faithful performance of these duties the HBR shall be
required to furnish a bond in such sum as the Branch may direct. For
these
services the Health Benefits Representative shall receive a salary of
one
hundred dollars ($100.00) per month payable quarterly.

TRUSTEES
SECTION 11. The Trustees shall
examine
and report to the Branch to condition of the books of the officers at
least
once every six months, compare the vouchers and records and see that
they
correspond with the collections and disbursements. They shall have
custody
of all Branch property and shall perform such other duties as the
Branch
By-Laws may require of them. The Board of Trustees shall be known as
the
Trustee of Golden Gate Branch 214 of the National Association of Letter
Carriers of the United States of America. They shall receive forty-five
dollars ($45.00) per month payable quarterly.

EEO OFFICER
SECTION 12. The EEO Officer will
supervise
the filing and processing of Equal Employment Opportunity
discrimination
complaints by the carriers we represent; and to organize the fight
against
discrimination in the Postal Service. For the faithful performance of
these
duties, the EEO Officer will receive forty-five dollars ($45.00) a
month,
payable quarterly.

DIRECTOR
OF
ORGANIZATION
SECTION 13. The Director of
Organization
will be responsible for assisting the full time officers in the
internal
organization of the branch, as well as ensuring the branch’s active
participation
in the labor movement, in community affairs, and in the struggles of
working
people for a better life, as directed by the president or the branch.
In
carrying out the internal organizing duties, the Director of
Organization
will initiate and encourage the development of a spirit of solidarity,
mutual support and mutual defense among the letter carriers. Internal
organizing
is understood to mean fostering the organization of any of a wide
variety
of union activities which serve to bring the membership together,
including
social and recreational activities. For the faithful performance of
these
duties, the Director of Organization shall receive forty-five dollars
($45.00)
per month, payable quarterly.

PART TIME
OFFICER SALARIES
AND OTHER DUTIES
SECTION 13. The salaries of
officers
paid quarterly shall be paid in the months of January, April, July and
October of each year.
SECTION 14. In addition to
assigned
duties, each officer shall perform such other duties as the Branch may
form time to time direct.

DUTIES OF
SHOP STEWARDS
SECTION 15.
1. All Shop Stewards shall be
responsible
for the following:
A. Knowledge of the contract and
administering of same.
B. Represent all members of the
station in any and all grievances.
C. Make all new employees aware
of the benefits and eligibility of membership in the Union.
D. Each Shop Steward shall see
that all new members have in their possession a copy of the National
Constitution,
a copy of the Branch By-Laws, a copy of the National Contract, and a
copy
of the Local Memorandum of Understanding.
E. Each Shop Steward shall be
paid
the sum equal to 4.5 hours pay level 5 Step O per month provided he or
she has attended two (2) out of three (3) Branch meetings prior to
payment,
or has requested to be excused for reasons of personal emergency, NALC
union business, or is out of town. The request for excuse must be made
to the President or the Secretary-Treasurer before the branch meeting,
if possible; if approved, the President or the Secretary-Treasurer will
initial the attendance book stating reason for excuse. The excused
absence
will be for the purpose of steward payment only and not for
compensatory
convention delegate eligibility. The level 5 Step O herein shall be
adjusted
annually on January 1 and shall be payable quarterly.
2. Members appointed by the
President
to function as Stewards to handle grievances at Step 2 shall be paid
the
sum equal to 4.5 hours pay level 5 step O per month, adjusted annually
on January 1, payable quarterly for the duration of their appointment
provided:
A. They attend at least two (2)
out of three (3) Branch meetings prior to the quarterly payment.
B. They are not concurrently
receiving
steward pay as a station steward.

EMPLOYEE
INVOLVEMENT
FACILITATORS
SECTION 16. E.I. Facilitators will
be responsible for the following:
A. Insuring that the Union
contract
and carrier rights are not violated in the E.I. process.
B. Promoting the interest of Branch
214 in the E.I. process.
C. Reporting to the Branch meeting
on E.I. activities in the Branch.
D. Each Facilitator shall be paid
sixty dollars ($60.00) per month payable quarterly provided they attend
at least two (2) out of three (3) Branch meetings prior to the
quarterly
payment and they are not concurrently receiving steward pay.

BONDING
SECTION 17. The
Secretary-Treasurer,
the Assistant Secretary-Treasurer and all Trustees shall be bonded in
accordance
with statutory requirements. All conditioned for the full and faithful
discharge of their duties, which bonds must be with a Surety Company,
approved
by and filed with the Board of Trustees within ten (10) days after
installation,
premiums on said bond to be borne by the Branch.

THE EXECUTIVE
BOARD
SECTION 18. The Executive Board
shall
consist of the following: President, Executive Vice President, Vice
President,
Secretary-Treasurer, Assistant Secretary-Treasurer, Safety & Health
Officer, EEO Officer, Director of Organization, Health Benefits
Representative,
MBA Representative, Sergeant-at-Arms, Trustees, all Shop Stewards, all
Committee Chairpersons. All Executive Board members shall be required
to
attend all meetings unless excused in advance by the President or any
other
presiding officer. The Executive Board shall meet at least once each
month.
The Secretary shall submit to the Editor of the Voice a summary of the
business transacted at the Executive Board meeting. Any member of the
Executive
Board who misses two (2) consecutive meetings without prior
authorization
shall be responsible to the President or presiding officer for
necessary
action.

ARTICLE VII
FEES, DUES, FINES AND
ASSESSMENTS
SECTION 1. The dues of the Golden
Gate
Branch 214 shall be $18.00 monthly. This amount shall be increased each
January at the rate of 1/10 of 1% of any raise in the base salary.
SECTION 2. All members who wish
to become Associate Members because of transfer within the Postal
Service
or promoted to supervisory status shall also pay the amount stated in
Section
1 of this article. All members who wish to become Associate Members
only
for the purpose of membership in the NALC sick benefits plan and/or the
NALC Life Insurance Plan shall pay seven dollars ($7.00) monthly.
SECTION 3. The dues of retired
members
of Branch 214 shall not exceed the annual per capita tax for retired
members
of the National Association of Letter Carriers and the California State
Association of Letter Carriers.
SECTION 4. The members may by
two-thirds
vote of the members present and voting at a regular meeting levy
assessments
upon the membership for specific purpose and they may also impose fines
upon members found guilty of charges preferred against them as members
by an officer of Branch 214.
SECTION 5. Any member leaving
the
Postal Service (career) for any reason other than retirement, shall be
dropped from membership within thirty (30) days, unless he or she
signifies
in writing to the Branch Secretary, within that time that he or she
wishes
to become an associate member. In the time of National Emergency or
when
this Nation is in a state or war, the dues of any member serving
actively
with the Armed Forces shall not be suspended providing that member
returns
to the Postal Service within ninety (90) days after date of discharge.
SECTION 6. The members may by
two-thirds
vote of the members present and voting at the regular meeting exempt
from
or remit the dues of any member who has been declared an emergency
case.
It shall also be ascertained for how long a period of time this payment
shall be made. Any member shall be allowed to pay his or her dues in
advance.
SECTION 7. Any member failing to
pay any fine, assessment or monthly dues within thirty (30) days after
the same shall become due shall forfeit his membership. He or she shall
vacate any office held in Branch 214 effective on the date of such
forfeiture.
He or she shall not be entitled to vote in the business of Branch 214
and
he or she shall not be eligible for nomination or be elected to any
office.
The Secretary-Treasurer shall notify this member of his delinquent
state
within seven (7) days. He or she shall then be allowed an additional
sixty
(60) days in which to conform to his/her delinquent fine, assessment or
dues.
SECTION 8. A former member whose
membership has been forfeited may be reinstated by the payment of all
back
fines, assessments and/or dues, as well as a reinstatement fee of fifty
dollars ($50.00).
SECTION 9. In the event the
National
Association or the State Association increases the per capita tax,
Golden
Gate Branch 214 shall increase its dues by the same amount.
SECTION 10. The rates of dues
and
initiation fees may be increased and assessment levied upon the
members,
only by majority vote by secret ballot of the regular members in good
standing
at a special or regular meeting after reasonable notice has been given
that this question will be before the meeting.

ARTICLE
VIII
SICK RELIEF, FUNERAL
BENEFITS, AND
RETIREMENT GIFTS
SECTION 1. On the death of a
member,
the President, at the request of the family of the deceased shall
appoint
a committee of not more than six members to act as Pallbearers. The
members
of this committee shall be paid not more than ten dollars ($10.00) each
for expenses. If Pallbearers are not requested by the family, the
President
shall appoint a committee of one to attend the funeral; he or she shall
be compensated the sum of ten dollars ($10.00).
SECTION 2. On the death of a
member
of this Branch, the Secretary-Treasurer shall send a floral piece,
spiritual
bouquet or other such memorial tribute, but not to exceed the sum of
twenty-five
dollars ($25.00).
SECTION 3. Upon notification
that
any member has been incapacitated by hospitalization or being
bedridden,
the Secretary-Treasurer shall send an appropriate acknowledgment.
SECTION 4. A retirement gift of
fifty dollars ($50.00) shall be given to each regular member retiring
from
the Postal Service if said regular has been in good standing with the
Branch
for the ten (10) year period immediately preceding retirement.

ARTICLE IX
COMMITTEES
SECTION 1. Immediately after being
installed, the President shall appoint the following committees:
A. Committee on organization
which
shall work in conjunction with and subordinate to the National
Executive
Council to secure such benefits as the National Association may desire.
B. The Budget Committee shall
consist
of five members to whom all bills and claims against the Branch shall
be
referred before being acted upon by the Branch. This Committee shall
consist
of the Secretary-Treasurer, who shall act as Committee Chair, the
Assistant
Secretary-Treasurer, and the three Trustees.
C. There shall be a committee
of
Labor-Management consisting of the President, Vice President,
Secretary-Treasurer,
and two (2) other members at large appointed by the President.
D. The President shall be the
ex-officio
member of all committees.
SECTION 2. The President shall
appoint
the following standing Committees:
Good of the Order
Sick Committee
Vending Fund
Safety and Health
Blood Bank
By-Laws
Special Craft Committee (City Delivery)

ARTICLE X
CHARGES
SECTION 1. Any member of the Branch
who shall violate any of the principals of the association or offend
against
its Constitution of By-Laws may have charges preferred against him or
her
and if such charges are proved shall be fined, reprimanded, suspended
or
expelled as the law may direct or Branch determine. All provisions of
Article
X of the National Constitution for the Government of Subordinate
Branches
shall apply.

ARTICLE XI
APPEALS
SECTION 1. An appeal may be taken
to
the President from the decision of any other officer of the Branch and
to the Branch from any decisions of the President, which appeal must be
taken at the meeting at which the subject appealed from is under
consideration
and before any other business not connected with said question shall
have
been taken up for action. Refer also to Article XI, Appeals, of the
National
Constitution for the Government of Subordinate Branches.

ARTICLE
XII
FUNDS
SECTION 1. The words to be used in
filling the black spaces in Article XII, Section 1, Constitution for
the
Government of Subordinate Branches, designated the amount to be
allotted
the Assistant Secretary-Treasurer for current expenses shall be fifty
dollars
($50.00).
SECTION 2. Any member who shall
retain tickets for any entertainment, picnic, or ball held by this
Branch,
or money received from any sale of tickets, shall be responsible for
same
and the amount due shall be charged to his dues account on the
Secretary-Treasurer's
books at the next regular meeting succeeding the committee's final
report.
SECTION 3. There shall be a
Convention
Fund, comprising of a fixed amount of one thousand four hundred dollars
($1400.00) per month. Any additional proceeds from Branch functions may
also be included.
SECTION 4. A motion for this
Branch
to borrow money or to contract a debt other than a current one, shall
be
passed only by a vote of two-thirds of the members present at a regular
or special meeting. THIS SHALL BE A STANDING VOTE.
FIXED EXPENSES
SECTION 5. A committee to be known
as the Budget Committee shall allot the financial obligations for each
six months of the year. They shall meet in June in order that they may
make a report at the July meeting, and in December in order that they
may
submit a report at the January meeting of all the obligations for the
ensuing
six months. This committee shall ascertain the expected revenue of the
Branch for the ensuing six months, and shall allocate the full amounts
for all fixed expenses. All funds over and above this amount shall be
placed
in the General Fund. No motion shall be entertained to remove money
from
the General Fund, unless approved beforehand by the Budget Committee,
and
in the event of their disapproval, by a two-thirds affirmative vote of
those present and voting at a regular meeting.
FIXED EXPENSES SHALL
INCLUDE:
1. Officers' salaries
2. Shop Steward expenses
3. Office expenses (Approx.)
4. Hall Rent
5. Social Security Tax
6. Unemployment Insurance
7. Funeral expenses (Approx.)
8. State Per Capita Tax
9. Dues to groups to which we are
affiliated, and Per Capita Tax of like groups
10. Election expenses
11. Convention Delegate expenses
(The amounts of this category fixed by Branch)
12. Attorney fees
13. Office rental
14. Legal counsel contingency fees
15. Officer's expenses
16. Good of the Order Committee
($250.00) per month
Any other fixed expenses of this section may be added to or
subtracted
from by the usual changes in By-Laws.
SECTION 6. The President shall
have
the authority to delegate to any member, in good standing to fulfill
any
assignment of Union business. Any and all such appointments, where
expenses
are incurred or lost time, the member so stated shall be permitted to
submit
such claims to the Budget Committee for full payment.

ARTICLE
XIII
INDEMNIFICATION
SECTION 1. The branch is authorized
upon affirmative vote of the membership, to pay all the expenses for
investigating
services, employment of counsel and other necessary expenditures in any
cause, matter or cases where an officer, representative, employee,
agent,
or one charged with acting in behalf of the Branch and/or its
affiliates
is charged with any violation of any law or is sued in any civil
actions
with respect to any matter arising out of his official duties except if
such officer, representative, employee or agent is charged with a
breach
of trust to the Branch or any subordinate body or member thereof. This
provision does not apply to suits brought against the Branch or any of
its officers, representatives and agents by the National Association.

ARTICLE
XIV
AMENDMENTS
SECTION 1. These By-Laws shall not
be suspended but may be altered or amended by two-thirds of the members
present and voting at any regular meeting called for that purpose,
provided
all proposed alterations or amendments be in writing, signed by five or
more members in good standing and be presented to the By-Laws Committee
of Branch 214 for study 28 days before the first reading on the Branch
floor. Action on proposed change shall be taken at the next regular
meeting
following the first reading.
SECTION 2. A defeated amendment
shall not be submitted in like form for six months thereafter.
